📦 Shipping Terms & Deadlines

Shipping Timeline:

• Shipments will start being packed the week following auction checkout (July 28th  -August 1st and start shipping out that week and the week after) Please contact us for shipping estimates . International buyers we do not alter invoices. The customs amount will be the amount from the bidder invoice 
• We estimate shipping dates but cannot control delays caused by third parties, weather, or unforeseen circumstances.

Delayed pickup items: 

Some auctions may feature items deemed “ delayed pickup”. There are times where to facilitate liquidations and logistics delayed pickups are required. We do our best to stay as close to the estimated dates as possible , however these are estimates and delays beyond our control can occur

Shipping Responsibility Disclaimer:

NexBid is an auction company, not a retailer, and shipping is not a condition of your bid. Shipping is a separate transaction, offered solely as a courtesy to our bidders. We are under no obligation to provide shipping as part of your winning bid.

We offer an estimate-based timeline for packing and carrier scheduling; however, these are not guaranteed shipping dates. Buyers always have the option to pick up their items in person if shipping delays are unacceptable.

Any delays in shipping, packing, or delivery do not entitle bidders to initiate chargebacks, as shipping is not part of the auction terms or the purchase contract.

📌 All shipments are at the buyer’s risk. NexBid strongly recommends purchasing shipping insurance.

Packing Fees:

• Packing fees apply to freight shipments or any ground shipments containing fragile or breakable items.

Freight Shipping Liability:

• Buyers are liable for any additional fees caused by:
  ✅ Rescheduling delivery
  ✅ Incorrect delivery address
  ✅ Failure to be available at the time of delivery
• Carriers charge for these issues, and buyers agree to pay any additional fees.
• Failure to pay within 48 hours authorizes NexBid to charge the card on file.

Freight Shipment Terms:

• Freight shipments DO NOT include indoor delivery. If indoor delivery is required, carriers charge an additional fee.

• All sales are final once the auction closes—bidders accept full responsibility for inspecting items before bidding.

• It is the bidder’s responsibility to inspect items before bidding and determine condition, age, completeness, and suitability for their intended use.
• Failure to inspect does not negate a winning bid.

• Many auction items, including restaurant equipment, vehicles, and electronics, are used, surplus, or may have unknown issues even if an item has been spot tested prior to listing. 
• There are no performance guarantees, and all items should be assumed to have wear and tear associated with prior use. Even of an item is listed as tested and working this does not constitute a warranty. Issues can arise from transport and shipping, refrigeration units can be damaged from laying them over etc. 
• If an item is listed as “new” or “unused,” this simply means it has not been previously operated—it does not imply a manufacturer’s warranty or guarantee of condition.

💰 Payment Terms & Chargeback Agreement

Chargebacks & Disputes:
🚨 By placing a bid, you agree that all sales are final.

• No refunds, chargebacks, or payment reversals will be permitted under any circumstances.
• You waive any right to dispute charges with your bank or credit card provider regarding winning bids.
• Failure to comply will result in legal action, collections, and account suspension.

Automatic Charges:

• We will begin automatically charging cards at 2:00 PM on the final pickup day for each auction.

Late Payment Fees:

• A $25 per day fee per invoice will be applied for past due payments. This daily fee will continue to accrue until the full amount is paid.
• Partial payments will NOT stop the accrual of late fees.

Unpaid Invoices & Collections:

• If an invoice remains unpaid after 14 days, it will be sent to collections.
• Any unpaid invoice over $2,500 will result in legal action.

✅ Item Removal & Auction Adjustments

• NexBid and/or the consignor may remove, withdraw, or modify any items from the auction prior to auction closing if necessary.
• This may occur due to clerical errors, duplicate listings, lost or damaged items, seller decisions, or unforeseen circumstances.

✅ Bidding & Reserve Protections

• In accordance with UCC 2-328, the auction company reserves the right to place bids on behalf of absentee bidders, internet bidders, or reserve bids, including but not limited to bids from banks, consignors, or other secured parties with a financial interest in the items.

🛠️ Buyers are fully responsible for removing their own items. This includes:

• Disconnecting any utilities (electric, gas, plumbing)

• Unbolting or disassembling equipment

• Bringing appropriate tools and help

🚜 A forklift will be available to assist with loading larger items only.

🚫 Important Conduct Notice for Onsite Auction Pickup:
Anyone found:

• Removing items from lots they did not win

• Altering or switching lot tags

• Handling other buyers’ property without permission

…will be immediately removed from the premises with no refunds and permanently banned from future auctions.
